@Mike403 I concur with @WriterGF and how he explained it. Defamation is about reputational harm. If someone believes their reputation has been harmed, regardless of whether it actually has, they can file a defamation lawsuit. That does not automatically mean they will win. They still have to convince a jury with a preponderance of evidence that they suffered reputational harm.
The point is, why on earth would CC want to take the risk of getting sued over this?
I have never been sued but I was subpoenaed as a witness in a federal civil rights case. I also had my email, text messages and hand written notes subpoenaed during discovery. I really doubt any of our moderators, who graciously donate their time to this site, want to be called as witnesses in a public trial and to be forced to turn over their electronic communications over something as dumb and useless as leaving a banned member’s photos up for all to see.

Apparently you can make baseless assertions, that a course of action that appears prudent to you is somehow grounded in law faster than I can refute them.
Lawyers get paid to argue opposing sides of an argument. So, I’ll ask around. But I’ve been a litigator for years. And I’m confident that an attorney bringing an argument like yours to a defamation case would likely be fined, and one who continued to do so, would likely have his license suspended.
No one will change a vote based on someone else’s comment here. Maybe that person just wants desperately to be taken seriously. It’s all good, here’s a 🤗
