This website (the “Website”) is operated by Cuddle Comfort Limited (“Cuddle Comfort”). The Terms of Use set forth below are binding on all users of this Website. By directing your browser to this Website or otherwise accessing the pages of this Website, you accept these Terms of Use. Cuddle Comfort may change the Terms of Use at any time at its sole discretion. Cuddle Comfort reserves the right, at its sole discretion, to deny further or continuing access to the Website to any visitor, including, without limitation, any user that Cuddle Comfort determines has violated any aspect of these Terms of Use. Cuddle Comfort reserves the right, at its sole discretion, to seek and obtain any other remedies available to it pursuant to any applicable laws and regulations or at equity as a result of your breach of these Terms of Use or any other act or omission by you that gives rise to a claim by Cuddle Comfort.

Adult users only

This Website is not intended for people under 18 years of age. If you are under 18, you are not authorized to use this Website and will not be afforded access to any features of this Website that allow for you to provide information to us or to share information with other users of this Website.

By accessing this Website, you agree to use any personal information provided to you by other users of this Website in a lawful and responsible manner. You further agree that you will not use personal information about other users of this Website for any reason without the express prior consent of the user that has provided such information to you.

Covid-19 and other illnesses

Please do not meet any members in person while infected with a contagious illness.

In addition, do not meet any members in person if any of the following applies to you:

In the 7 days prior to your meet-up, you have a positive Antigen test for Covid-19 (usually taken using a swab of the nose/throat), or newly develop any of the symptoms of COVID-19 including: a new continuous cough; a high fever; a change to sense of taste or smell; or flu-like symptoms (including: blocked or runny nose; sore throat; muscle aches and pains; or new headaches).
In the 14 days prior to your meet-up, someone within your household or support bubble has a positive Antigen test for Covid-19 or newly develops symptoms of COVID-19 as above.
You have been instructed by the government or other public health agency to self-isolate in the 14 days prior to your meet-up.
If – in the 14 days prior to your meet-up - you return from a country which requires a period of quarantine under government guidelines.
The area where you currently live/reside is placed into a local Covid-19 lockdown.

Personal boundaries

You agree to never use this Website for the intent of meeting another member for sex. You also agree to never attempt to progress a meeting, organised via this website, to a sexual nature.

When communicating with another member, you agree to never indicate a desire to cuddle while doing any of the following: (1) being nude, (2) wearing only underwear, (3) kissing, (4) groping, (5) satisfying a fetish or kink, and (6) anything of a non-platonic nature.

Privacy

You should appreciate that all information submitted on the Website might potentially be publicly accessible. Important and private information should be protected by you. We are not responsible for protecting, nor are we liable for failing to protect, the privacy of electronic mail or other information transferred through the Internet or any other network that you may utilize. See Cuddle Comfort’s privacy policy for more information regarding privacy. The privacy policy is incorporated into and a part of these Terms of Use.

Security

Cuddle Comfort uses industry standard efforts, such as firewalls, to safeguard the confidentiality of your personally identifiable information. However, perfect security does not exist on the internet; Cuddle Comfort cannot and does not guarantee that any personally identifiable information provided to us will not become public under any circumstances.

Professional cuddling

We do not endorse nor check the credibility or authenticity of any members, including those who are labeled as 'Professional'. You should therefore always exercise due diligence independent of this website to satisfy your own peace of mind in regards to safety.

By choosing to have a session with a professional cuddler on this website, you are agreeing to the Client Service Agreement found here. If instead you are here as a professional cuddler, by using this website you are agreeing to the Cuddler Contract found here.

If you wish to be a Professional Cuddler on our website, you must apply here. If you already have an existing account that has not been upgraded to professional tier, you must inform us of your username by using the contact us form. We can then begin the upgrade process for your account. Failing to do this breaches our terms and could lead to permanent account termination. For more information about applying to be a professional cuddler, read this page.

Platonic services only

This site is intended for platonic services only. Members found to be attempting to solicit or offer non-platonic services (i.e. fetish related, sexual services, etc.) through Cuddle Comfort will be banned. In addition, professional cuddlers found to be offering these services outside of this website will also be banned. This is to further keep our image separate from such activities, particularly in light of U.S. legislation (i.e FOSTA-SESTA).

Paid-for accounts and paid features

Cuddle Comfort is free, but if you would like to upgrade to a Professional Cuddler account or any other paid features (the "Service"), the following terms apply.

Billing and Payment. Cuddle Comfort bills you through an online account for use of the Service. You agree to pay Cuddle Comfort all charges you subscribe for on the Website using this online account. Cuddle Comfort may correct any billing errors or mistakes that it makes even if it has already requested or received payment. This paragraph includes any agreements you make on the Website when you purchase the Service. You agree to maintain current, complete and accurate information for your billing account at any time you have a subscription. In addition, you authorize us to obtain updated or replacement expiration dates and card numbers for you credit or debit card as provided by your credit or debit card issuer.

Automatic renewal

(1) Your subscription for the Service will continue indefinitely until cancelled by you. After your initial subscription period, and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when subscribing. You agree that your account will be subject to this automatic renewal feature. If you want to terminate your subscription, please log in and go to the Settings page to downgrade or delete your account. If you cancel your subscription, your subscription will not be renewed thereafter and you won’t be eligible for a prorated refund of any portion of the subscription fee paid for the then-current subscription period.

(2) By subscribing, you authorize Cuddle Comfort to charge your credit card, debit card or other payment method at such time and again at the beginning of any subsequent subscription period, including any sales or similar taxes imposed on your subscription payments. Upon the renewal of your subscription, if Cuddle Comfort does not receive payment, you agree that Cuddle Comfort may either terminate or suspend your subscription and continue to attempt to charge your payment method provider until payment is received (upon receipt of payment, your account will be activated and for purposes of automatic renewal, your new subscription commitment period will begin as of the day payment was received). If you do not terminate your subscription and/or if you continue to use the Service, you agree that Cuddle Comfort is authorized to charge the payment method in your online account. Cuddle Comfort may also seek payment directly from you. Your charges may be payable in advance, in arrears, per usage, or as otherwise described when you initially subscribed to the Service.

No refunds

REFUNDS WILL NOT BE PROVIDED FOR ANY SUBSCRIPTION. WE DO NOT PROVIDE CREDIT, REFUNDS, OR PRORATED BILLING FOR SUBSCRIPTIONS THAT ARE CANCELLED MID-MONTH. We reserve the right to offer refunds, discounts or other consideration in select circumstances at our sole discretion. Please note that each circumstance is unique and election to make such an offer in one instance does not create the obligation to do so in another.

Commission-based accounts

Cuddle Comfort will collect session fees from the Professional Cuddler’s card on file after a session has been completed. This charge typically occurs around 48 hours after the scheduled start time of the session.

If a session does not occur, the Professional Cuddler should void the fee by cancelling the session on the Cuddle Comfort website. This can be done via the booking panel that appears above the conversation with the client. In such a scenario where the Professional Cuddler fails to do this, they can request a refund for the session fee after the charge occurs.

Whether we choose to refund a session fee is at our sole discretion and based on the circumstances relating to the account and transaction. Please note that each circumstance is unique and election to issue a refund in one instance does not create the obligation to do so in another.

Access and proprietary rights

So long as you comply with these Terms of Use, you are authorized to access, use and make a limited number of copies of information and materials available on this Website only for purposes of your personal use in order to learn more about Cuddle Comfort or its products and services, or to otherwise communicate with Cuddle Comfort or utilize its services. Any copies made by you must retain without modification any and all copyright notices and other proprietary marks. The pages and content on this Website may not be copied, distributed, modified, published, or transmitted in any other manner, including use for creative work or to sell or promote other products. Violation of this restriction may result in infringement of intellectual property and contractual rights of Cuddle Comfort or third parties which is prohibited by law and could result in substantial civil and criminal penalties. Cuddle Comfort, CuddleComfort.com, and other identifying marks of Cuddle Comfort are proprietary to Cuddle Comfort. You may not use these marks for any purpose without the express prior written consent of Cuddle Comfort. Except as expressly set forth above, these Terms of Use do not grant to you any express, implied or other license or right under any patent, trademark or copyright of Cuddle Comfort or any third party.

In certain instances, Cuddle Comfort may agree to provide you with access to secure, password protected pages of the Website. Such access is restricted to authorized users only; any attempt by you to access these areas without authorization may subject you to criminal or civil liability.

Data Retention of accounts that breach our terms

We reserve the right to indefinitely retain the profile and associated data of any account that breaches our terms & conditions, forum rules or professional cuddling agreements. We may use this data to block the offending user from accessing the website again. We may also use the data to help us identify any attempts to bypass those preventative measures. The data of these banned or suspended accounts are therefore critical to our business.

Featured Profiles

Cuddle Comfort may feature any profile at any time to the publicly accessible home page of this website without notification to, nor prior consent from, the profile owner. Once a profile is featured on the home page, we have the right to change the contents and appearance of said profile for any reason and without notification to, nor prior consent from, the profile owner.

Unique and bona fide profile

You agree to create only one unique profile. In addition, in order to maintain the integrity of the Website, by joining, you agree that your use of the Website shall be for bona fide cuddle-seeking purposes (for example, you may not use the Website solely to compile a report of singles in your area, or to write a school research paper). From time to time, we may create test profiles in order to monitor the operation of our services.

Profile photos

We have strict rules for what photos you are allowed to upload to your profile.
